Entry for this contest ends on April 30, 2010. The prize drawing will be held on May 15th. One entry per person. The winner will be notified within 14 days of the draw by email. The (ARV:) $1799 US prize (for one adult) is non-transferable and substitutions will not be permitted. The prize is for a 9 day Discovery Adventures' "Ancient Incas of Peru" (Trip Code: SPPAD) for (1) one person including 5 nights accommodations, 3 nights camping, 8 Breakfasts, 5 Lunches, 4 Dinners and local flights but does not include international flights to Lima, insurance, incidentals or other third party services as determined. The prize is only valid on small group tours, and trip must be booked by August 31, 2010 and travel completed by December 31, 2010. It is the responsibility of the winner to contact Discovery Adventures Sales department (as provided) by June 15, 2010 in order to claim the prize. This prize is non-transferable and has no cash redemption value. You must be 18 or older to claim the prize. Please note that as a prize winner, you may only book onto departures that are guaranteed to depart and have reached their minimum participant requirements. Gap Adventures & Discovery Adventures reserves the right to substitute tours for operational resources and blackout dates may apply. Participants acknowledge these contest rules are to be interpreted in accordance with the laws of Canada and laws of Ontario. By entering the contest and agreeing to our terms and conditions, the winners confirm their eligibility and compliance with the contest rules and release Gap Adventures & Discovery Adventures, its partners including Discovery Communications and affiliates from all liability caused by, or resulting from, the acceptance or use of the contest prize. The Sponsors reserve the right to cancel or modify any Contest or the Contest Rules at any time without notice.

1. PRIZE CONDITIONS: All Prize winners will be required to execute an Affidavit of Eligibility, a Liability Release, where legal, and a Publicity Release. All documents must be returned to Gap Adventures and Discovery Adventures by the date and/or time indicated within such documents. If a potential winner fails to return such documents within the specified time period, or if an entrant is found to be ineligible, or if he/she does not comply with the Official Rules, then the potential winner will be disqualified and an alternate winner will be selected. If a prize or prize notification is returned as undeliverable, this will result in disqualification and an alternate winner will be selected. All prizes claims will be awarded. Except where prohibited by law, the winner’s entry and acceptance of the prize constitutes winner’s permission for Gap Adventures and Discovery Adventures to use said winner’s name, photograph, likeness, statements, biographical information, voice, and address (city and state only) on a worldwide basis, and in all forms of media, in perpetuity, without further compensation.

2. GENERAL: Taxes on prizes and all expenses related to acceptance and use of prizes and not specified are the sole responsibility of winners. By entering the Contest, entrants agree to be bound by these Official Rules and the decisions of Gap Adventures and Discovery Adventures which shall be final and binding in all respects. By participating in this Contest and/or by accepting any prize that they may win, entrant agrees for entrant and for entrant’s heirs, executors, and administrators (i) to release Gap Adventures, Discovery Adventures and each of its respective parent, subsidiary and affiliated companies, units and divisions and advertising and promotional agencies and prize suppliers; and each of their respective officers, directors, agents, representatives and employees; and each of these companies and individuals' respective successors, representatives and assigns from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from or in connection with participation in this Contest and/or acceptance or use of any awarded prize, (ii) to indemnify Gap Adventures, Discovery Adventures and each of its respective parent, subsidiary and affiliated companies, units and divisions and advertising and promotional agencies and prize suppliers; and each of their respective officers, directors, agents, representatives and employees; and each of these companies and individuals' respective successors, representatives and assigns from any and all liability resulting or arising from the Contest, and (iii) that Gap Adventures and Discovery Adventures have neither made nor is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize. Entry constitutes permission (except where prohibited by law) to use winner's name, city, state, likeness, voice, biographical information and statements for purposes of advertising, promotion and publicity in any and all media, now or hereafter known, throughout the world in perpetuity without additional compensation, notification, permission or approval.

3. WAIVER: Gap Adventures and Discovery Adventures is not responsible for any technical, mechanical, printing, typographical, human or other error or any kind relating to or in connection with the Contest, including, without limitation, errors which may occur in the administration of the Sweepstakes, the processing of entries, the announcement of the prize or any Contest-related materials; or for any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest, incomplete, lost, late, stolen, damaged, inaccurate, illegible, misdirected, garbled, delayed or undelivered entries; or for technical hardware or software malfunctions or failures of any kind, lost, unavailable network connections, or failed, incomplete, garbled or delayed computer transmission, which may limit an individual’s ability to participate. Gap Adventures and Discovery Adventures reserve the right in its sole discretion, to cancel, suspend or modify the Sweepstakes, or to disqualify any implicated entrant(s), (and their entries) if any fraud, virus, actions by entrants, technical or other error or problem of any kind, or any other occurrence corrupts or affects the administration, integrity, security, or proper play of the Contest, as determined by Gap Adventures and Discovery Adventures in their sole discretion. In the event of cancellation, Gap Adventures and Discovery Adventures reserve the right, at its sole discretion, to award any prize in a random drawing from among all eligible, non-suspect entries received up to the time of the event or action warranting such cancellation. CAUTION: Any attempt by an entrant to undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws, and should such an attempt be made, Gap Adventures and Discovery Adventures reserve the right to seek damages from any such entrant to the fullest extent permitted by law, including criminal prosecution. Gap Adventures and Discovery Adventures are not responsible for any failure to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Gap Adventures and Discovery Adventures or other “force majeure” event.
